Terms and Conditions of Sale
Please Read Carefully

Ordering

Where possible we invite our clients to visit our workshop by appointment for a free design consultation at the time of ordering their instrument. This is by no means necessary (and of course impractical for overseas clients) and all instrument details, spec options etc. will be fully discussed and confirmed in writing before work commences.

The 50% deposit is charged at the time of starting work (i.e. spending hours) and ordering materials as a security for both the client and for Sabre Guitars. It is therefore non-refundable. There may be someone else lower down on the waiting list that will be happy to take over the build, and we may sometimes be able to solve situations where you need to back out of the order in that way. This cannot be guaranteed however and Sabre Guitars accepts no liability for any losses sustained if a client cannot continue with a build once the deposit has been paid.

If using our monthly payment scheme, terms are as follows: The first instalment is due upon receipt of the invoice. Each subsequent instalment is due on the same day of each following month. i.e if the initial payment is made on the 1st May, the next instalment is due on the 1st June etc. Build times and waiting list times remain the same as all other builds, therefore customers using this option may, under some circumstances have paid off the entire instrument before it is completed. This is not a finance agreement, therefore materials will be purchased and work will be carried out based on the amount which has been paid off in order that Sabre is not out of pocket. If a monthly payment date is missed once the build has commenced, a charge of 5% of the Total cost of the instrument will be added to the final price, rising by an additional 5% per payment missed (i.e 10% for a second missed payment, 15% for a third until the outstanding balance is brought up to date) if late/non-payment continues. If any three instalments are missed during the course of the build (these do not have to be consecutive), Sabre will request payment of the complete remaining balance, plus any additional fees immediately. If, in these circumstances, the balance is not paid within 5 working days of its request, the build will be cancelled, and Sabre will retain any payments already received and also retain ownership of the guitar in its current build state plus any and all yet-unused hardware and materials to recoup costs.

As a small company, we have intentionally limited our maximum production capacity based on current man-power and average build time in order that we never exceed our ability to produce instruments to the same uncompromising standard and within the bounds of our estimated completion dates for each client. As a result Sabre currently allows a maximum of 18 builds in progress at any one time. This works out at roughly 3-5 guitars being finished and delivered each month. If clients wish to order a guitar and there are no free build slots available we operate a waiting list. Clients can secure a place on the waiting list by paying a small non-refundable 10% deposit. Once a build slot opens up and we are ready to begin their instrument the client is then required to pay the remaining 40% before work commences.

Our standard accepted payment method is via Wire Transfer. Domestic and International bank details are provided on the invoice at the time of purchase. We also accept payment via PayPal (Both balance transfer and card payment) however in these cases an additional charge will be payable by the client (between 3.9% and 5%) to cover PayPal fees.

The build process

Our current build times are on average between 4-6 months however this is an estimate and the actual build time can vary by up to 6 months depending on model, options and wood choice. We are constantly updating and adding to our wood store, however as a small enterprise Sabre Guitars purchases around 90% of the tonewood used in our guitars on an individual order basis. As a result the condition and moisture content of wood varies greatly upon arrival at our workshop and can sometimes take weeks or even months to be seasoned up or down to the correct condition for a client’s build.

As well as our website, Sabre Guitars’ most prominent client-facing medium is our Facebook page. We post regular updates from the workshop a number of times per week and this is the best way to keep up to date with current builds etc. Because of the small size of our team we rarely have time to send photographs/updates to each client unless specifically requested. (With up to 18 guitars in production we would never get any work done otherwise!) So we recommend checking the Facebook page often.

 We welcome any comments throughout the build and the smallest change can make a great instrument into the perfect instrument for you. Once the specifications of a custom build have been finalised and work on the instrument has commenced there will be a 10% surcharge plus material and time costs on any changes to those specifications, which would require additional design work, programming, machining, hardware or materials. This surcharge is in no way intended to deter clients from changing their specifications if necessary. Our aim is to build every client their ideal instrument however the additional charge reflects the impact that late changes have on our build schedule, and therefore our other clients.

Delivery/Returns

Approximately 1-2 weeks before a build is due for completion Sabre guitars will send notification to the client in writing along with a final invoice for the due balance, which is only payable once further notification has been given that the build is complete and ready to ship. Sabre Guitars will provide detailed images of the finished instrument along with these notifications. Sending the balance, plus any shipping costs, signifies the client agrees that the instrument has been built to their specifications and that they are happy with the build quality etc. If a client collects the instrument in person then acceptance of the instrument constitutes the same agreement to the above. Once the balance and/or shipping charges have cleared Sabre Guitars will schedule the shipping/delivery/collection of your instrument. All domestic and international shipments are booked through either Parcelforce or FedEx unless customer specifies otherwise  and are fully insured to the value of the instrument. The customer accepts all liability for any additional customs/import duties or charges which may be payable.

If full payment of the balance owing is not paid within 30 days of notification of completion without obtaining prior, written permission from Sabre Guitars then the client will lose all rights to it. The instrument will become the sole property of Sabre Guitars and will be sold to cover costs or used from then on as demonstration stock.

In the unlikely even that an instrument is found to be damaged or faulty upon delivery, it must be returned to us WITHIN 7 DAYS of receipt along with notification of the above, in writing for appraisal to determine the cause.

In the even a refund is agreed upon, it will be processed within 28 Days. 

All Sabre Guitars instruments are covered by the Limited Warranty detailed below:  

 

Limited Warranty for all instruments built by Sabre Guitars (Christian Howes Music Limited).

1)    Warranty Terms and Conditions.

SABRE GUITARS warrants solely to the original purchaser of this SABRE GUITARS musical instrument that the instrument purchased shall be free from defects in materials and workmanship under normal use for a period of 1 year from the date of delivery/collection, or until the ownership of the instrument is transferred to another party. This Limited Warranty does not apply: (a) to wear or breakage of frets or strings, or other normal wear and tear of the instrument or its parts; (b) to asserted defects caused by modification, misuse or abuse or improper maintenance of the instrument; (c) to asserted defects involving subjective personal likes or judgements; (d) to asserted defects caused by accident or exposure to extremes of temperature or humidity which cause harm to the instrument; (e) to defects asserted by any party other than the ORIGINAL PURCHASER or who did not purchase the instrument directly from SABRE GUITARS or from an authorized SABRE GUITARS dealer in the United Kingdom.

2)    Limitation on Obligations.

The obligations of SABRE GUITARS hereunder are limited to repair or replacement of parts of the instrument found to be defective under this Limited Warranty. In no event shall SABRE GUITARS be liable for any indirect, incidental or consequential damages, including but not limited to time, wages or lost profits, of any nature or kind or for damages to or loss of property.

3)    No Other Warranties.

The Limited Warranty set forth herein constitutes the entire warranty and representation SABRE GUITARS. This Limited Warranty shall be controlling over any conflicting terms and conditions of any purchase orders, contracts or invoices, which may be executed in connection with the purchase of the SABRE GUITARS musical instrument. NO representation or warranty made by any SABRE GUITARS salesperson, dealer, agent, representative or employee shall be binding upon SABRE GUITARS other than as set forth herein.

 

THE TERMS OUTLINED BELOW DO NOT APPLY TO THE CUSTOM BUILT INSTRUMENTS DETAILED ABOVE AND ARE ONLY RELEVANT TO PURCHASES OF PICKUPS, HARDWARE, ACCESSORIES, STOCK BUILT INSTRUMENTS AND MERCHANDISE FROM OUR WEB STORE.

For clients purchasing hardware/accessories/stock built instruments* through our e-commerce store.

Delivery/Returns

We will post to any address, as long the address at which your payment card is registered is also present on your order. When you add products to your Shopping Basket, all available delivery options will be displayed. You can select the option you think most appropriate for your items.

Most small parcels will be delivered via Royal Mail 1st class, more valuable items by 1st class recorded. Larger items, such as bodies and complete guitars will be sent via courier. The contents of your order and your delivery postcode area will determine which delivery services you will be offered. We do not deliver to Post Office (P.O.) boxes or shipping agent addresses.

* “Stock Built Instruments” Refers only to those that are already fully finished items at the point of sale, advertised as such on the Sabre Guitars Web Store and purchased without any additional modification or customisation by Sabre Guitars before delivery. Instruments which have been modified in any way to comply with a customer’s individually chosen specification (i.e installing a different set of pickups, alternative hardware, etc.) is classified as a “Custom Instrument” and will be sold under the terms and conditions stated above relating to Custom Instruments.

We aim to despatch all orders within 2 working days of receiving your order.  However, in some cases this may not be possible. In such cases orders will be posted within 14 days. This includes Signed for and international deliveries. Orders involving parcel couriers (Guitar bodies, complete guitars) will be scheduled for collection within 14 days after cleared payment. Please note: Orders are not usually processed for shipment on weekends and holidays

Force Majeure

Sabre Guitars shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Faulty Goods

All goods are new, unless stated otherwise, and as such should arrive in perfect condition. Should you receive a damaged or faulty item please let us know and we will exchange the item or provide you with a full refund (whichever you prefer). Any item found to be damaged or faulty when received must be returned to us WITHIN 7 DAYS of receipt. Please contact us through the links on our website for address details. There will be no additional postal/delivery costs for replaced items.

Non-Faulty Goods

We accept the return of goods that were wrongly ordered (or ordered in error) for exchange or refund. These items must be returned to us carriage paid in the original packing and in a saleable condition WITHIN 7 DAYS of receipt. P & P or carriage on exchange/replacement item is chargeable.

Cancellation of Orders

You are able to cancel your order prior to shipping with no cost penalty being incurred and full credit of your account if monies have already been taken. You can cancel an order by following the links on the Sabre Guitars website, or by phoning us on 07515939353.

 

The Small Print!

Sabre Guitars does not accept responsibilities beyond those set forth here, including any liability for products not being available for use, or for the provision of services and support. Sabre Guitars shall not be liable for loss of profits, loss of business, or other consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein. Clients agree that for any liability related to the purchase of products or services, Sabre Guitars is not liable or responsible for any amount of damages above the amount paid by the client for the purchase of products or services. Under no circumstances, including, but not limited to, negligence, shall Sabre Guitars be liable for any direct, indirect, special, incidental, or consequential damages, including, but not limited to, loss of profit arising out of the use, or the inability to use, the materials on this site, even if Sabre Guitars has been advised of the possibility of such damages. If your use of the materials or information on this site results in the need for servicing or repair, Sabre Guitars shall not be liable for any costs incurred. Sabre Guitars continually upgrades, improves, and revises its products and services to provide clients with new products and services. Sabre Guitars may revise or discontinue products at any time without prior notice to clients. Natural oil and/or wax finishes with stains are liable to fading during the first year and stains on lacquered instruments will fade through exposure to natural light. Sabre Guitars will ship products that have the functionality and performance of the products ordered, but changes between what is shipped and what is described in a specification sheet or catalogue are possible (Changes of this sort will be advised in writing prior to shipping). These terms are subject to change without notice.
